POLICY OVERVIEW

NoBrand Cloud ("we") applies an absolute zero-tolerance policy to SPAM, spam marketing, unsolicited bulk email (UBE), and unsolicited commercial email (UCE).

To protect the reputation of our IP space and the normal operation of our mail infrastructure, all users purchasing or using NoBrand Cloud IP addresses and server resources must strictly comply with this Policy.

1. DEFINITION OF SPAM

For the purposes of this Policy, spam or unsolicited email means any bulk or individual electronic communication sent to a recipient who has not expressly granted permission to receive it, including by opting in through a double opt-in mechanism. This includes, but is not limited to:

  • (a)Commercial advertisements, promotions, political messages, religious messages, or defamatory messages sent without request or permission.
  • (b)Messages that hide, falsify, or alter sender identity, reply address, source IP, or mail header information.
  • (c)Messages containing fraud, phishing, malware, malicious code, or deceptive links.

2. USER RESPONSIBILITY AND OUTBOUND TRAFFIC

  • (a)Primary responsibility: as the direct contractual customer of NoBrand Cloud, you are fully responsible for all IP addresses, servers, and outbound traffic assigned to your account, regardless of whether spam is sent by your end users or by attackers exploiting your systems.
  • (b)Abuse complaint handling: when our Abuse monitoring system receives a third-party complaint regarding spam sent from your IP address, we will forward the complaint to your registered email address. You must provide a substantive technical response and remediation within twenty-four (24) hours, such as closing port 25, removing malicious mail software, or blocking the offending user. Failure to respond in time, or refusal to respond, may result in service interruption or suspension.

3. PROHIBITED CONDUCT

  • (a)Operating a mail server, mailing software, or virtual host specifically for bulk advertising using NoBrand Cloud services or resources is prohibited.
  • (b)Sending spam on other networks while linking to or referencing URLs, domains, web pages, or IP addresses hosted on the NoBrand Cloud network in the message is prohibited.
  • (c)Collecting, buying, selling, or scraping non-compliant email address lists through unlawful technical means for bulk mailing is prohibited.

4. BREACH LIABILITY

If NoBrand Cloud independently confirms, or if reports from authoritative blacklist organizations such as Spamhaus or SORBS confirm, that your service is sending spam or UBE:

  • (a)We may permanently block port 25 on the server or account, or suspend the service immediately.
  • (b)If spam activity causes NoBrand Cloud physical IP ranges or ASN to be blacklisted, the offending account may be terminated immediately without refund.
  • (c)The user must fully compensate NoBrand Cloud for all direct and indirect losses arising from remediation, IP reputation recovery, IP replacement, litigation, and related investigations.
